Terms and Conditions – Listen2Them

1. Introduction

Welcome to [Listen2Them] (“the Service”). By booking a session, or otherwise using the Service, you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Service.

2. Description of the Service

Listen2Them provides a platform that connects Users with listeners for live video‑conference sessions. During a session, the User speaks freely while the listener provides attentive, non‑judgmental presence.

Non‑Medical Disclaimer: The Service is not medical, psychological, therapeutic, or professional counseling. Listeners are not licensed clinicians, therapists, or counselors. We encourage you to seek out help from a licensed professional if necessary.
Purpose: Sessions are intended solely for personal expression, venting, or informal conversation.

3. Eligibility

You must be at least 18 years old to use the Service.

By using the Service, you represent and warrant that you have the legal capacity to enter into a binding contract.

5. Booking & Payments

Sessions are booked through the Service’s scheduling interface.

Prices, payment methods, and cancellation policies are displayed at the time of booking.

All fees are non‑refundable unless otherwise stated in the Cancellation Policy (see Section 6).

6. Cancellation & Rescheduling

User‑initiated cancellations: Must be made at least [24] hours before the scheduled start time or have a strong reason to receive a credit or refund.

Listener‑initiated cancellations: Will be refunded in full or rescheduled at the User’s convenience.

The Service reserves the right to cancel or reschedule a session for technical or safety reasons, in which case a full refund will be provided.

7. Conduct & Prohibited Activities

Both Users and Listeners must adhere to the following:

Respectful Interaction
Do: Speak honestly, listen attentively, treat each other with courtesy.
Do Not: Harass, threaten, intimidate, or use hate speech.

Legal Compliance
Do: Follow all applicable laws.
Do Not: Engage in illegal activity, solicit illegal actions, or discuss illicit behavior.

Content
Do: Share personal experiences, emotions, or thoughts.
Do Not: Provide medical, legal, or financial advice; claim professional qualifications you do not hold.

Privacy
Do: Keep personal data of the other party confidential.
Do Not: Record, screenshot, or distribute session content without explicit consent.

Violations may result in immediate termination of service.

8. Confidentiality & Recording

Sessions are private and confidential. Neither party may record, transcribe, or share any portion of a session without the explicit, written consent of the other party.

The Service does not store audio/video recordings of sessions, but metadata (e.g., timestamps, duration) may be retained for billing and analytics.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.

The Service makes no representations regarding the suitability, reliability, or effectiveness of the listening experience for any particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law:

The Service, its owners, employees, and affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service.

The total aggregate liability of the Service for any claim shall not exceed the amount you paid for the specific session that gave rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Service and its affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of:

Your breach of these Terms;
Your violation of any law or third‑party rights; or
Any content you submit, post, or transmit through the Service.

12. Intellectual Property

All trademarks, logos, and brand elements of the Service are the property of Listen2Them.

Users retain ownership of any original content they share during sessions, but grant the Service a worldwide, royalty‑free, non‑exclusive license to use such content solely for operational purposes (e.g., billing, analytics).

13. Modifications to the Terms

The Service may revise these Terms at any time. Revised Terms will be posted on the website and become effective immediately after posting. Continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of United States, Arizona, without regard to conflict‑of‑law principles. Any disputes will be resolved exclusively in the courts located in Arizona, United States, unless alternative dispute resolution is mutually agreed upon.
